Once the driver returns home, he/she will face criminal prosecution in their own state. The IDLC is an agreement between 45 states to share information when a driver is arrested, charged, or cited for a traffic violation.

There are only 5 states in the country that are not members of the IDLC: Georgia, Massachusetts, Michigan, Tennessee, and Wisconsin. If a driver is a resident of one of these states, he/she will still face legal prosecution in California, but the authorities in his/her home state will not be notified of the offense.
