Alameda County DUI Lawyer
2nd, 3rd & 4th DUI

Because of the number of accidents, injuries, and deaths that occur as the result of drunk driving on California’s roads and highways, judges, prosecutors, and law enforcement officers in Alameda County take all drunk driving offenses very seriously. When a person is arrested on DUI charges, he/she stands to face a number of adverse legal penalties, such as monetary fines, driver’s license suspension, mandatory alcohol treatment, community service, and even time in jail. By penalizing drunk drivers for their irresponsible actions, it is hoped that they will have learned from their mistakes, and discontinue to drive while under the influence. Unfortunately, this is not always the case, as some drivers do not learn their lesson, and continue to drive drunk.

When a person is arrested and charged with a second, third, or fourth DUI, he or she will face much more serious consequences then those offenders arrested for a first-time DUI.  In the eyes of the law, multiple DUI offenders have a blatant disregard and disrespect for the safety and well-being of themselves and others, and therefore deserve to be severely punished. All multiple DUI offenders in Alameda County can expect to experience harsh prosecution and stern reception from judges. Upon conviction of a second, third, or fourth DUI, an offender may face the following legal penalties:

2nd DUI (within 10 years) – No Probation
Jail: 90 days to 1 year
Fine:  $390.00 to $1,000.00, with possible penalty assessments
License Suspension:  up to 2 years
Treatment Program:  18 months or 30 months in drug/alcohol treatment program

2nd DUI (within 10 years) – Probation
Jail: 96 hours to 1 year
Fine:  $390.00 to $1,000.00, with possible penalty assessments
License Suspension:  up to 2 years
Treatment Program:  18 months or 30 months in drug/alcohol treatment program

3rd DUI Offense (within 10 years)
Jail: 120 days to 1 year
Fine:  $390.00 to $1,000.00, with possible penalty assessments
License Suspension:  up to 3 years
Treatment Program:  18 months or 30 months in drug/alcohol treatment program

4th DUI (within 10 years)
Jail: 180 days to 16 months
Fine:  $390.00 to $1,000.00, with possible penalty assessments
License Suspension:  up to 4 years

It should be noted that these penalties may be increased depending on the circumstances surrounding the arrest. This is called “enhancement.” Common reasons to enhance legal penalties include:

  • If the driver caused an accident
  • If the accident resulted in injury, death, or extensive property damage
  • If children were in the car or involved in the accident
  • If the driver’s BAC is above .20%
  • If the driver is driving on a suspended license or driving without a license altogether
